• You will not use our services to send unsolicited communications, spam, or any content that violates applicable messaging laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
• You are responsible for ensuring that any contact lists or databases you provide to us have been collected lawfully and that recipients have consented to receive communications where required by law.
• You will not engage in any activity that disrupts, damages, or impairs the integrity or performance of our services or infrastructure.

2. AI-Powered Services & Results

Lenova.ai provides AI automation services including but not limited to database reactivation, speed-to-lead follow-up, out-of-hours booking, voice AI, Google review responses, and abandoned cart recovery.

• All results, projections, and case studies shared on our website represent past performance and are not guarantees of future results. Individual outcomes will vary based on industry, database quality, offer, and market conditions.
• Lenova.ai is not responsible for the content of AI-generated messages where the client has provided custom instructions, scripts, or personas that deviate from our standard setup.
• We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3. Client Responsibilities

As a client of Lenova.ai, you are responsible for:

• Providing accurate business information, contact lists, and campaign details necessary to deliver our services.
• Ensuring compliance with all applicable messaging regulations (TCPA, GDPR, CAN-SPAM, etc.) for your jurisdiction and industry.
• Obtaining all necessary consents from your contacts prior to initiating any AI-powered outreach campaigns.
• Maintaining the confidentiality of any account credentials or access provided to you.
• Promptly notifying us of any unauthorized use of your account or any security breach.

4. Intellectual Property

• All content, branding, technology, workflows, system architecture, prompt frameworks, and materials provided by Lenova.ai are our exclusive property and are protected by copyright, trademark, and other intellectual property laws.
• You may not use our trademarks, logos, brand assets, or proprietary materials without prior written permission from Lenova.ai.
• Any custom deliverables created specifically for your business remain your property upon full payment, but Lenova.ai retains the right to use anonymized performance data for internal improvement and marketing purposes.

5. Payment & Refund Policy

• All fees for services are outlined in your service agreement or proposal and are due as specified therein.
• Lenova.ai operates on a results-first model where applicable. Specific payment terms will be detailed in your individual agreement.
• Refunds, where applicable, are handled on a case-by-case basis at the sole discretion of Lenova.ai and must be requested within 14 days of the relevant service period.
• We reserve the right to suspend services for accounts with outstanding balances.

6. Limitation of Liability

Lenova.ai provides its services "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities arising from your use of our services.
• Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the total fees paid by you to Lenova.ai in the three months preceding the claim.
• We are not responsible for third-party platform changes (including GoHighLevel, Zapier, or any other integrated tools) that may affect service delivery.

7. Third-Party Services & Integrations

Our services may integrate with third-party platforms including GoHighLevel, Zapier, Twilio, OpenAI, and others. Use of these platforms is subject to their own terms of service and privacy policies. Lenova.ai is not responsible for the practices or availability of any third-party services.

8. Confidentiality

Both parties agree to keep confidential any proprietary information, business data, client lists, strategies, or technical details shared during the course of our working relationship. This obligation survives the termination of any service agreement.

9. Termination

Either party may terminate a service engagement with written notice as specified in the applicable service agreement. Lenova.ai reserves the right to immediately terminate access to our services for violation of these Terms & Conditions without refund.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

11. Changes to These Terms

We may update these Terms & Conditions at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of our services following any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.

12. SMS Program & Messaging Terms

By engaging Lenova.ai's SMS automation services or submitting your phone number through any of our forms, you agree to the following:

• SMS Program Description: Lenova.ai operates AI-powered SMS messaging programs on behalf of itself and its clients, including database reactivation, lead follow-up, appointment booking, and promotional communications relevant to the services you have inquired about or engaged with.
• Opt-Out Instructions: You may opt out of SMS communications at any time by replying STOP to any message you receive. After opting out, you will receive one final confirmation message and no further SMS communications will be sent. To re-subscribe, reply START.
• Message & Frequency: Message Frequency: Message frequency may vary. Users can expect to receive approximately 5 messages per month, which may include appointment reminders, follow-ups, account notifications, and promotional communications.
• Message & Data Rates: Message and data rates may apply depending on your mobile carrier and plan. Lenova.ai is not responsible for any charges incurred from your carrier in connection with SMS communications.
• Age Restriction: By providing your phone number and consenting to receive SMS communications, you confirm that you are 18 years of age or older. Our SMS programs are not intended for individuals under the age of 18.
• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.
